WTO Finds EU Steel Safeguard Measures Inconsistent

On 29th April 2022, the World Trade Organization adopted a panel report which found that the EU steel safeguard measures are inconsistent with the WTO rules.

This was first claimed by Turkey, which requested first consultations with the EU in March 2020, but the report was delayed and issued only in April 2022, due to the Covid-19 pandemic.

Based on the report results, the European Union must now put in place some recommendations and a review. The European Commission is indeed expected to examine again those measures, by asking interested parties to give all essential information to complete the data collected during the investigation.

In previous cases in which a review was undertaken following a finding of WTO inconsistency, the European Commission’s new conclusions led to a repeal of the anti-dumping duties. As such, this review could lead to the repeal of the EU steel safeguard measures on some, or all, of the product categories covered by the EU steel safeguard measures.
