CECE voices industry’s concerns to lead MEP on ePrivacy file

In a bilateral meeting with MEP Sippel (Germany – S&D) CECE raised some pressing concerns from construction equipment manufacturers about the draft text of the European ePrivacy Regulation. As the leading MEP on this file, Mrs. Sippel was very keen in hearing CECE’s point of view about the impact of such a Regulation protecting privacy on the construction industry.

Indeed, the most fundamental issue mentioned by the Chair of CECE’s working group on Data regulation, Charlotte Le Bozec (CISMA – Caterpillar), is the inclusion of machine-to-machine communications in the scope of the draft Regulation. As previously stated by CECE, our purely business-to-business environment does not aim to capture communication of or about natural persons and the type of communication that happens on a construction site between machines follows the model of contractual freedom.   This is why, CECE urged MEP Sippel to make sure that the legal framework for machine manufacturers will be limited to the protection of personal data through the EU General Data Protection Regulation, due to enter into force in May 2018. Mrs. Sippel agreed that if there is no personal data involved in our communication, the ePrivacy regulation should not come under consideration.   CECE will continue its advocacy so that machine-to-machine communications for the construction industry are not unnecessarily pulled in the scope of the ePrivacy Regulation.
